Compliance forms a fundamental part of every property transaction, ensuring that all processes are conducted in accordance with current legislation while protecting the interests of both buyers and sellers. At Landmark Property Solutions, we follow a structured and transparent approach to compliance, incorporating the requirements of the Financial Intelligence Centre Act (FICA), the Protection of Personal Information Act (POPIA), and all relevant property-related compliance certifications.

As part of our FICA obligations, all clients are required to complete an identification and verification process prior to the conclusion of any transaction. This includes the submission of supporting documentation such as identity documents, proof of address, and, where applicable, confirmation of the source of funds. These measures are essential in meeting anti-money laundering requirements and ensuring the legitimacy of each transaction.

In addition, all personal information collected during this process is managed in accordance with POPIA. We are committed to maintaining the confidentiality and security of client information, ensuring that data is collected only for lawful purposes and handled with the necessary safeguards. Clients can therefore proceed with confidence, knowing that their personal information is protected and processed responsibly.

Property transactions also require compliance with various statutory certificates, which may include electrical compliance certificates, plumbing certificates, gas certificates, and beetle certificates where applicable. These certifications are typically obtained prior to transfer and confirm that the property meets the required safety and regulatory standards.

Throughout the process, we work in close collaboration with conveyancers and relevant service providers to ensure that all compliance requirements are met efficiently and without unnecessary delays. Clear guidance is provided at each stage, allowing clients to navigate the process with ease and certainty.

  • Proof of residential address (not older than 3 months)
  • Certified copy of Identity Document or Passport
  • Income confirmation (where applicable)
  • Source of funds (e.g. bank statements, sale agreements, inheritance confirmation)

For Companies / Trusts:

  • Company/Trust registration documents
  • Director/Trustee identification documents
  • Proof of business address
  • Resolution authorising the transaction
  • Beneficial ownership information

For Sellers (Property Compliance Certificates):

  • Electrical Compliance Certificate (CoC)
  • Plumbing Compliance Certificate (where applicable)
  • Gas Compliance Certificate (if installed)
  • Beetle Certificate (applicable in certain regions)

Our Compliance Approach

Our compliance processes are guided by a risk-based framework in line with our internal Risk Management and Compliance Programme (RMCP). This approach allows us to:

We do not receive or handle cash transactions (notes or coins), and all compliance procedures are conducted in line with current regulatory expectations applicable to property practitioners in South Africa.
